New contract clause – suspension of specialties
Background
As part of a review of its practices and processes, the Translation Bureau has eliminated the permanent removal of specialties and changed the specialty suspension periods in cases of contract termination.
It was therefore decided that a new clause concerning specialty suspension periods would be inserted into all translation services contracts. This clause is now part of all open contracts.
New clause regarding the suspension of specialties
- If Canada terminates the Contract owing to default, Canada may
- suspend for a period of twelve months the specialty or specialties in which there were unsatisfactory evaluations giving rise to the termination;
- suspend for a period of twelve months all specialties specified in the Contract in the event of a failure to meet any or all of the obligations arising from the Contract, in addition to the obligation stated in (i) above.
- Upon the fifth contract termination within a period of five years, the suspension period for the specialties subject to a suspension under (i) or (ii) will increase from twelve to twenty-four months. If the supplier has not had a contract terminated in five years, the twelve month suspension period for contract terminations is reinstated, and (i) and (ii) once again apply.
- Nothing in this section infringes upon the rights and remedies to which Canada may otherwise be entitled under the Contract.
